Submitting a report of illegal content

In accordance with Article 16 of the DSA, hosting service providers, including online platforms, must provide users with the possibility to notify them of any illegal content accessible through their services. Notifications are submitted directly to the service provider and must contain certain elements, such as the grounds for the notification, information on the location of the content, the notifier's email address, and a statement by the notifier that the information provided is accurate and complete.

Notification mechanisms must be easily accessible, user-friendly and allow for the submission of notifications exclusively by electronic means. The hosting service provider must send the notifier an acknowledgement of receipt without undue delay. The provider must also inform the notifier without undue delay of its decision regarding the information to which the notification relates and provide information on any legal remedies available in relation to that decision.

If a hosting service provider does not provide adequate notification and action mechanisms, this may constitute a breach of the DSA for which the user may lodge a complaint against the provider with AKOS as the competent Digital Services Coordinator.
