Responsible and diligent conduct by providers of intermediary services is essential for a safe, predictable and trustworthy online environment and for making it possible for EU citizens and others to exercise their fundamental rights, in particular freedom of expression and access to information, freedom to conduct a business and the right to non-discrimination, and to achieve a high level of consumer protection. Regulation (EU) 2022/2065 on a Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act) lays down new obligations for providers of intermediary services. The scope of providers' obligations depends on the type, size and nature of the intermediary service concerned.
Intermediary services include mere conduit services, caching services and hosting services, including online platforms. A special category of services is represented by VLOPs and VLOSEs.
Providers of intermediary services which are micro or small enterprises, as defined in Recommendation 2003/361/EC, are subject to several exemptions from the obligations.
